Dutch Authority Launches DSA Compliance Tool for Businesses

The Dutch competition authority, ACM, has introduced the DSA check, an online tool designed to help businesses determine their compliance with the Digital Services Act (DSA). This initiative aims to create a safer online environment for both consumers and businesses.


The Netherlands Authority for Consumers and Markets (ACM) has launched the DSA check, an online tool that assists website and app owners in identifying the specific rules of the Digital Services Act (DSA) that apply to them. This tool is accessible on ACM’s official website.

Starting February 2024, new European regulations will be enforced for providers of online intermediaries and platforms, aimed at fostering a safe, reliable, and predictable online environment for businesses and consumers alike. The DSA introduces a tiered system of obligations, meaning that different rules apply to different companies, and some rules may only pertain to specific services offered by a company.

The DSA check is specifically designed for two main groups: websites and apps that feature user-generated content, and online stores and marketplaces. Given the comprehensive nature of the DSA rules, both large and small businesses are required to comply. Smaller businesses, which often lack in-house legal support, can particularly benefit from the DSA check to understand their obligations.

In addition to the DSA check, ACM has provided various resources to explain the DSA rules. These include published guidelines, webinars aimed at small to medium-sized enterprises, and targeted guidance documents available on ACM’s website. Furthermore, consumers can access information about their rights under the DSA through ACM’s consumer information portal, ACM ConsuWijzer.
