Austrian Authority Reviews Rail Power Supply Contracts Amid Competition Concerns

The Austrian competition authority has initiated a comprehensive evaluation of energy supply contracts and the rail power system following complaints about potential competitive restrictions.

In November 2023, the Austrian competition authority, known as BWB, was alerted to possible issues in the rail power supply market by the Rail Control Commission. Concerns were raised regarding the energy supply contracts used by ÖBB Infra and the overall rail power system, which could lead to competitive restrictions. The rail power market has been liberalized since 2016.

Austria has a separate electricity network specifically for electric train operations, which differs from other networks due to the lower frequency of electricity required for train operations compared to household use. This rail power distribution network is operated by ÖBB Infra, allowing railway companies to source the necessary power either from ÖBB Infra or alternative energy providers after conversion to the correct frequency.

The BWB conducted extensive investigations and collaborated closely with the Rail Control Commission. This included multiple requests for information from ÖBB Infra and a market survey of railway companies. Throughout the investigation, ÖBB Infra cooperated fully with the BWB, providing essential information. Ultimately, the initial suspicion of abuse of a dominant market position was not substantiated, leading to the closure of the BWB's investigation.

In response to the findings, ÖBB Infra committed to a comprehensive evaluation of its existing rail power offerings and systems, involving feedback from its rail power customers. The aim is to ensure fair competitive conditions and explore potential new product options that promote flexible and competitive energy supply while identifying areas for further development in the rail power system.
