The Polish competition authority, UOKiK, has fined Bunge Polska 4,289,397.19 PLN for including clauses in their contracts with farmers that unfairly limited the farmers' ability to escape liability for non-performance due to circumstances beyond their control.

Bunge Polska, part of a major global agribusiness group, was found to have shifted the risk of force majeure events, such as late frosts and droughts, onto farmers. This practice could lead to farmers being penalized for not delivering contracted products when their crops were damaged by such events.

UOKiK President Tomasz Chróstny emphasized the vulnerability of farmers in the market and the importance of ensuring that contracts do not strip them of their rights in adverse conditions. The authority's actions aim to protect weaker market participants and support Poland's food security.

Following UOKiK's objections, Bunge Polska promptly revised its contract templates and ceased the contested practices. The company cooperated with UOKiK during the investigation, which contributed to the reduction of the fine. Without this cooperation, the penalty would have been significantly higher.

UOKiK's role includes eliminating practices that violate the rights of weaker market participants, and the fines serve as a deterrent while also promoting the swift correction of irregularities. The decision will formally take effect on September 4, 2026.
