On June 30, 2025, Guilhem Issartel, a senior lawyer, and Philipp Noppeney, an economist from the Luxembourg competition authority, participated in a summer course organized by the European Law Academy (ERA) in Trier. Their presentation aimed to provide attendees with a comprehensive understanding of anticompetitive agreements and concerted practices.
The session covered key aspects of Article 101 of the Treaty on the Functioning of the European Union (TFEU), including the definitions of undertakings and associations of undertakings. They discussed various forms of agreements, decisions by associations, and concerted practices that may lead to anticompetitive behavior.
Participants learned about restrictions by object and effect, the impact on trade between member states, and the European Commission's guidelines. The discussion also highlighted the concept of a significant effect on competition and the de minimis communication.
To enhance understanding, the speakers provided practical examples drawn from recent case law and conducted a case study focusing on Article 101 TFEU, allowing attendees to apply theoretical knowledge to real-world scenarios.
